Appointing acting IGP is President’s constitutional responsibility – Saliya Peiris

There is no validity in the statement made by the Prime Minister in Parliament on the 26th regarding the appointment of an Acting Inspector General of Police says Saliya Peiris, President’s Counsel of the Lawyers Collective. He says the Prime Minister’s statement that the Constituent Assembly cannot be challenged in court is baseless.
“Today, the Prime Minister stated that the court cannot question the decisions of the Constitution Council. That matter is entirely false. The Prime Minister should read Article 41 (O) of the Constitution. It states that the decisions of the Constitutional Council are subject to the jurisdiction of the Supreme Court. If the President says today that he cannot perform the duties of the office, then he should temporarily leave and hand over to someone who can do it. There are provisions in the constitution for that, too.
The President should appoint the Acting Inspector General of Police. It is a constitutional responsibility. He cannot avoid it,” says President’s Counsel Saliya Peiris.
