The Court of Appeal yesterday (27) further considered the petition filed by former State Intelligence Service (SIS) chief Suresh Sallay against his arrest and detention under the Prevention of Terrorism Act (PTA) in connection with the Easter Sunday attacks.<\/p>\n\n\n\n
Appearing on behalf of the respondents, Deputy Solicitor General Suharshi Herath raised preliminary objections for the first time. The preliminary objections highlighted that the petitioner had not approached the court with clean hands, demonstrating how half-truths were presented and key facts were concealed in the petition.<\/p>\n\n\n\n
Furthermore, it was revealed in court that although Sallay had claimed to the Criminal Investigation Department (CID) that he had surrendered his diplomatic passport to the Ministry of Foreign Affairs, he had not actually done so.<\/p>\n\n\n\n
The Deputy Solicitor General also pointed out that while claims were made stating Sallay remained in India around the days of the Easter attacks, official Indian entry\/exit stamps on his passport proved he had left India on several occasions during that period.<\/p>\n\n\n\n
Requesting the court to dismiss the petition, the Deputy Solicitor General emphasized that the petitioner had failed to substantiate even these fundamental requirements before the court.<\/p>\n
